01 Acceptance of Terms
By accessing or using Indaggo, you agree to be bound by these Terms and Conditions and any additional terms and policies referenced herein. If you do not agree to all the terms and conditions, you may not use the software.
02 Use of the Software
Eligibility
You must be at least 18 years old to use Indaggo. By using the software, you represent and warrant that you are of legal age and have the authority to enter into these terms.
License
Indaggo grants you a non-exclusive, non-transferable, limited license to access and use the software for your personal or internal business purposes in accordance with these terms.
Prohibited Uses
You agree not to use Indaggo for any unlawful purpose or in a manner that violates any applicable laws or regulations. You also agree not to:
- Modify, adapt, translate, or reverse engineer any part of the software.
- Use the software to transmit any viruses, malware, or other harmful code.
- Interfere with or disrupt the integrity or performance of the software or its related systems.
03 User Account
Registration
To use certain features of Indaggo, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Indaggo immediately of any unauthorized use of your account.
04 Data Privacy
Data Collection
Indaggo may collect and process personal information as described in our Privacy Policy. By using the software, you consent to such collection and processing.
Data Security
Indaggo implements reasonable security measures to protect your data. However, you acknowledge that no method of transmission over the Internet or electronic storage is 100% secure, and Indaggo cannot guarantee absolute security.
05 Intellectual Property
Ownership
Indaggo and its licensors retain all rights, title, and interest in and to the software, including all intellectual property rights.
Feedback
If you provide any feedback or suggestions regarding Indaggo, you grant Indaggo a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use and incorporate such feedback into the software without restriction.
06 Disclaimer of Warranties
Indaggo is provided “as is” and “as available” without any warranties of any kind, whether express or implied. Indaggo disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
07 Limitation of Liability
To the fullest extent permitted by law, Indaggo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the software; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the software; or (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our software by any third party.
08 Indemnification
You agree to indemnify and hold harmless Indaggo, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the software, or your violation of these terms.
09 Governing Law
These terms shall be governed by and construed in accordance with the laws of Ontario, without regard to its conflict of law principles.
10 Changes to Terms
Indaggo reserves the right to modify these terms at any time. We will notify you of any changes by posting the new terms on the software. Your continued use of Indaggo after such changes have been made constitutes your acceptance of the new terms.
